Chapter 13 Bankruptcy sometimes allows the debtor to discharge general unsecured debt. Many factors can affect a Chapter 13 debtor's plan payment requirements. In some cases, a debtor is required to repay all of the general unsecured debt. In other cases, though, a Chapter 13 debtor is only required to repay a portion of the general unsecured debt. In the latter type of case, the debtor, at the conclusion of the commitment period, is able to discharge the remaining portion of the debt.
The factors that affect a Chapter 13 debtor's repayment requirements include, but are not limited to, the following factors: available income, reasonable and necessary living expenses, the type of debts included in the plan, the value of the debtor's assets.
