Wage Garnishment is a common method used by debt collectors to satisfy a debt that has gone into default. In Illinois, the debt collector usually is required to obtain a court judgement before the Wage Garnishment can be initiated. If the debt collector follows all of the legal requirements, it can obtain a court order requiring the employer to withhold a certain amount from the debtor's pay check until the debt is fully satisfied. Both Chapter 7 Bankruptcy and Chapter 13 Bankruptcy can eliminate Wage Garnishments.
